Try putting this file in the game's prg folder (same as with the pirates program). This is the file that manages enemy encounters. Tried the same hack with this one... worth a shot!
Are you playing on Win 7 64 bit by any chance? I played a few minutes of DAX on my system and noticed some things behaving strangely. I've yet to do a thorough play-through on a modern system, though I've been meaning to sometime.
