According to the hand held Black Jack game (which I obtained in Las Vegas) that inspired me to write the program, the ace is worth 11 if it's the first card and 1 otherwise. Actually, you can't choose anyway, since the opponent sees your first card (although I've seen it played the other way as well).
As for the second rule, I never heard of it, although it doesn't seem like a bad idea.
Variations in rules are not errors!
